Subject: Community Service Leave
It appears from the questions being asked that the Leave Policy needs more explanation. There are three categories that need to be addressed: National Guard Call-up, jury duty, and community service. Two of these, National Guard and jury duty are covered by an early Utah State Attorney General's opinion. The opinion states that employees may choose which of their remuneration checks to keep. Usually an employee will keep the larger check and turn the other check into the District. By following this procedure, days away from the District will not be counted as leave used. However, this memo places a 120 workday (not calendar days) limit on the attorney general's opinion. If leave is longer than 120 days, the remuneration earned is the remuneration kept. A leave of absence is then extended until the end of service.
In the case of community service, six officials are identified as community servants. There may be others: State Legislators, Mayors, Institutional Councilors, County Commissioners, various Governor's or Utah State Committee members, and Bishops.
Each of these positions is treated according to the remuneration they receive from their service (expense reimbursement not counted). The daily remuneration that is earned by these employees from their community service is deducted from their District paycheck up to the cost of a District substitute whether or not the substitute is used. For instance, if an employee earns a daily rate of $30 through community service, there will be a $30 deduction from the District check for each day of absence attributed to community service. If an employee earns a daily rate of $300 through community service, there will be a $65 + Social Security (today's cost of a substitute) deduction from the district check for each day of absence attributed to community service. Part days will be prorated. If there is no remuneration for community service, there will be no deduction from the district check. Community service days are limited to 13.5 days per year. Community service days used beyond this limit must either be used according to the regular leave policy or a day's pay must be forfeited for each day beyond 13.5.
Note also that both checks may be kept if the regular leave policy is followed with days deducted when absent from district responsibilities.
